Welcome to Tonight? by CerQ. By accessing or using the Tonight? mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By creating an account, you represent and warrant that you meet this age requirement. The App is currently available to users in Saudi Arabia, with a focus on Jeddah.

2. Account Registration

To access the App, you must register using a valid invite code from an existing member or submit an access request for admin approval. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity under your account

3. Invite System

The App operates on an invite-only model. Each member receives a limited number of invite codes per month. You agree to:

• Use invite codes responsibly and only share them with individuals you trust
• Not sell, trade, or publicly distribute invite codes
• Accept that invite privileges may be modified or revoked at our discretion

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Share your account credentials with others
• Create multiple accounts
• Use automated systems (bots, scrapers) to access the App
• Misrepresent your identity or affiliation

5. Content and Venue Information

The App provides curated venue recommendations for informational purposes only. We do not guarantee:

• The accuracy, completeness, or timeliness of venue information
• Venue availability, pricing, or quality
• That venues will meet your expectations

Venue details including names, addresses, and images may be sourced from third-party services such as Google Places. We are not affiliated with the venues listed unless explicitly stated.

6. User Conduct and Community Standards

Tonight? is a curated, exclusive community. We reserve the right to:

• Approve or deny access requests at our sole discretion
• Deactivate or suspend accounts that violate these Terms
• Remove users who engage in behavior detrimental to the community
• Modify user roles and permissions as necessary

7. Intellectual Property

All content, features, and functionality of the App (including text, graphics, logos, and software) are owned by CerQ and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

8. Push Notifications

By enabling push notifications, you consent to receiving messages about daily picks, updates, and community announcements. You may disable notifications at any time through your device settings.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, CerQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, including but not limited to any experiences at recommended venues.

12. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. You may request account deletion by contacting us at support@cerq-sa.com.

13. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the App. Your continued use of the App following any changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Jeddah, Saudi Arabia.
